In case you missed it..."On March 9th, GSP troopers will conduct the
"B.E.A.S.T." event. The Biker Education Awareness Safety Team consists of state
troopers patrolling Interstate 95 for a day. The troopers will stop
motorcyclists and will check their helmets, among other equipment, to see that
they are Department of Transportation (D.O.T.) approved. Trooper Harris said the
reason for this 2nd annual event isn't to ticket bikers, rather it's to get them
to be safer, if possible."

  Look for these BEAST check points on I-95 and I-75, same as they did last year.

Once again, motorcyclists are being targeted for these "inspections" as a result
of fatality car/bike crashes in which the car driver was at fault, but they want
to profile and harass motorcyclists to make them safer? Educate the motoring
public at large to be more aware of motorcyclists, enforce the texting while
driving and other driving while distracted laws and make car drivers more aware
of bikers, then maybe we won't have so many bikers killed or maimed, resulting
in these intrusive inspections.

How’s the Federal Highway Bill?
It's been a tumultuous few weeks, with Washington focusing all of its attention on the federal highway bill.  The mammoth piece of legislation that paves new roads and fixes crumbling bridges has been a ghost for the past three years, when the old law expired. Since 2009, the bill has lurched from temporary extension to temporary extension, and the most recent expires at the end of this month. The Motorcycle Riders Foundation (MRF) believes that another extension is a foregone conclusion at this point. The only question is how long will it be. Here is a quick rundown of where we are and where we have been.
The Senate passed a bill (S 1813) out of committee back in December. That bill is awaiting consideration by the full Senate, but it failed a cloture motion earlier this week. A vote against cloture is a vote to keep debating the bill and not begin voting on the bill. Failing a cloture vote is oftentimes the beginning of the end. Not always though, as we may see with this bill. Sources close to the MRF are saying that a deal has been reached between Senate Democrats and Republicans, and votes on amendments may wrap up next week. The Senate bill spends $109 billion over two years and has no anti-motorcycle language or helmet language of any kind.
Meanwhile, over on the House side, their version (HR 7) of the highway bill has an even more bizarre story. The House bill would spend $260 billion over five years. This bill also has zero anti-motorcycle language. It does have the language from HR 904 rolled into it, banning motorcycle-only checkpoints. Although the annual cost is actually less with the House bill, the overall cost proved to be too much for some Republicans in Congress, and they planned a revolt. The threat of the revolt was enough to force Speaker Boehner to divide the bill into three smaller bills; an odd choice of strategy. None of those bills have been brought to the floor. Supposedly there is so much rancor that the House may now take up the smaller Senate bill as a supplement, as it's more likely to get signed into law before the end of the month.  But even that is long shot.
In other news, Virginia Governor Bob McDonnell signed into law a piece of legislation that bans law enforcement agencies from conducting motorcycle-only roadside checkpoints. The ban takes effect July 1, 2012.

MOTORCYCLE SALES HOLD STEADY FOR 2011

The 2011 motorcycle sales estimates from the Motorcycle Industry Council are in, with annual unit sales holding steady at 440,000. The good news: motorcycle sales haven’t declined from 2010. The bad news: they haven’t gone up either. The MIC reports 440,899 total motorcycle sales for 2011, up 0.3% from 2010’s unit tally.
 
The motorcycle market shows gains and losses within the various segments, reports www.motorcycle-usa.com, noting that the largest sector, on-highway motorcycles, recorded a 1.8% increase over last year at 312,124 units. The boom and bust scooter market benefited with an 11.8% gain at 31,850 units. The biggest winner, however, was the dual segment which jumped 14.2% for the year, gaining 3337 units.
 
Off-Highway motorcycle sales dropped 13.5% on the year, losing 10,905 units from the 2010 tally of 80,962. Combined with the ATV market, which continued a downward sales trend, more than 45K OHV unit sales were lost on the year.
 
The 2011 total 440K annual motorcycle sales mark shows stabilizing of a market that crashed following the economic crisis in late 2008. Total motorcycle unit sales topped 1.1 million in 2008 (the sixth consecutive year sales had topped the million unit mark), but plummeted 40.8% in 2009, followed by a further 15.8% decline in 2010.

WORLD-FIRST STUDY ON CAUSE OF SERIOUS MOTORCYCLE ACCIDENTS

A world-first study will examine the cause of serious motorbike crashes. Motorcyclists will be part of a $1.3 million Australian study aimed at slashing the number of motorcycle accidents. The ground-breaking inquiry will compare the experiences of riders injured in crashes at specific sites with riders who have travelled through the same site safely.
 
Transport Minister Terry Mulder described the new research as one of the most comprehensive motorbike studies attempted globally. "By comparing the two groups, we hope to learn not only what went wrong for those involved in crashes, but also what went right for those who negotiated a particular crash site safely," Mulder said.
 
More than 1100 riders - half of whom have survived crashes - will be recruited over the next 18 months. The research is being funded by the State Government and headed by the Monash University Accident Research Centre (MUARC). Experts, five of whom are motorcyclists themselves, will analyze factors such as speed, experience and the physical environment in accidents.
 
Experienced and active riders have contributed to the questionnaire design to ensure relevance and improve study outcomes.
 
Results are expected towards the end of 2013.

FLORIDA SEEKS STIFFER PENALTIES FOR NEGLIGENT DRIVERS

ABATE Florida members from around the state were out in full force at the state capitol on Monday, Feb. 13th asking lawmakers for safer roads and to support legislation for stricter penalties for drivers who kill bikers on the road.
 
“Kill a motorcyclist they get an $82 fine, that’s all they get; failure to yield. You do that in a car, hit somebody else in a car, you get vehicular manslaughter,” said James “Doc” Reichenbach, ABATE President.
 
Reichenbach, who also serves as Chairman of the Board for the National Coalition of Motorcyclists (NCOM), testified on behalf of ABATE’s Stiffer Penalties Bill, S.B. 1754, which passed the Senate Transportation Committee on Jan. 27th by a vote of 7-0, and now goes to the Senate Criminal Justice Committee.
 
During the rally in Tallahassee, the names of bikers killed in wrecks last year were read aloud. Fifty-six bell chimes were sounded; one for each lost life. The bikers spent the rest of the day talking to lawmakers, then headed home hoping when they return next year, there are fewer bells to ring and fewer bikers lost.

VIRGINIA MAY LEGALIZE TWO-ABREAST RIDING

The Virginia General Assembly is considering the repeal of a 40-plus year-old law that makes it against the law for two motorcyclists to ride side-by-side in the same lane. Virginia and Vermont are the only two states in the U.S. with such a law on the books, while 48 other states either don’t ban the practice or have specific laws allowing it. There’s no indication those states have more crashes or problems related to two-abreast riding, according to the Virginia Coalition of Motorcyclists.
 
The proposal, sponsored by 26th District Delegate Tony Wilt and 18th District Delegate Michael Webert, sailed through the transportation committee and, overwhelmingly, through the House.
 
The law is an old one, possibly sparked by the menacing image of motorcycle gangs of the 60s. But since the law was passed over four decades ago, motorcycle registrations have shot up and charitable motorcyclists now ride in large groups for fund-raisers or to raise awareness, when riding two-deep is common.
 
Two-thirds of multi-vehicle motorcycle crashes are caused by people in cars who don’t see the riders. Two abreast may enhance visibility. And since motorcycles generally have one headlight, riding together can help illuminate dark roads.

Senate Highway Bill Passes
The United States Senate passed its version of a federal highway bill today. The measure (S 1813) provides $109 billion over two years for highway projects. The final vote was 74-22.  The bill moved quite quickly, considering the speed of the Senate these days. There was some discussion over amendments, the bulk of which were rejected.
The Motorcycle Riders Foundation (MRF) is pleased to report that no federal helmet mandates are attached to this bill, which in the past has been the case. Even the last version of the bill that was voted on in 2005 had a full floor vote on an amendment that would have required every state to have a full mandatory helmet law, or have millions of dollars of their highway funds withheld.
"This year the mandatory helmet law issue was only a small part of the very early discussion of the Senate bill," said Jeff Hennie, MRF Vice President of Government Relations and Public Affairs. "Senator Frank Lautenberg (D-NJ) filed a few motorcycle amendments during the committee phase, but he did not bring them up for a vote," he added.
The future is blurry for the Senate bill, as the House of Representatives has been flip-flopping on supporting it. Right now the House is supporting its own five-year bill, but it has not been brought for a floor vote.
While the MRF supports the House bill because it contains the language that would ban federal funding of mandatory motorcycle roadside checkpoints, it's not likely to see the return of the 2010 funds. Both the House and Senate bills send all safety money in one pot back to the states to give them flexibility.

New Virginia law bars motorcycle-only checkpoints

In a victory for motorcyclists, Virginia is the latest state to bar motorcycle-only checkpoints, the American Motorcyclist Association (AMA) reports.

On Feb. 28, Virginia Gov. Bob McDonnell signed into law H.B. 187, which was introduced by Delegate C. Todd Gilbert (R-Shenandoah). The new law, which takes effect July 1, prohibits law enforcement agencies from establishing checkpoints where the only vehicles subject to inspection are motorcycles.

The measure was introduced after the Arlington County Police Department set up a motorcycle-only checkpoint during the Rolling Thunder ride on May 28, 2011, that brings awareness to prisoner of war/missing in action (POW/MIA) issues.

Similar laws have been enacted in New Hampshire and North Carolina.

"Officials say they set up these motorcycle-only checkpoints to pull over motorcyclists to check for safety violations," said Rick Podliska, a Virginia resident and AMA deputy director of government relations. "But if officials are really concerned about motorcyclists' safety, then they need to stop discriminating against us with these checkpoints and start supporting programs that prevent motorcycle crashes, such as rider safety training and driver awareness programs."

The AMA opposes motorcycle-only checkpoints and has been tracking the discriminatory practice since it first appeared in New York several years ago.

Helmet Law Introduced in MN Legislature

A motorcycle helmet law proposal has been introduced in the Minnesota House and Senate. Here is the short description:

Motorcycle owners required to bear the economic costs of their injuries not caused by others, motorcycle owners required to comply with the motor vehicle insurance requirements that apply to other motor vehicles, and motorcycle riders required to wear helmets subject to an exception.

The following are some of the highlights of the bill: (c) A person over the age of 18 years may operate or ride a motorcycle without 3.21wearing the protective headgear required under paragraph (a) if the owner of the 3.22motorcycle has a plan of reparation security, as defined in section 65B.43, subdivision 3.2315, on the motorcycle that provides medical expense benefits of at least $250,000 and at 3.24least that amount for the total of income loss, replacement services loss, funeral expense 3.25loss, survivor's economic loss, and survivor's replacement services loss, all as described 3.26in section 65B.44. A person exercising the option provided under this paragraph must 3.27display, in the appropriate place on the motorcycle, the special license plate required under 3.28section 168.013, subdivision 1b. 3.29EFFECTIVE DATE.This section is effective January 1, 2013.

We all need to contact our State Representatives and Senators and ask them to support our rights as adults to make adult choices. We need to ask them to help us focus on public awareness, rider education, and crash prevention. We need to help them understand that making it safer for us to crash is not the answer, crash prevention is the only true lifesaver for us. Ask them to vote against HF2755 and SF2381.These bill are currently waiting to be heard in the MN House of Representatives Commerce and Regulatory Reform Committee and the MN Senate Transportation Committee.

Black Hills National Forest Advisory Board Announces Public Meetings   
AMA Action Alert

The Black Hills National Forest Advisory Board (NFAB) has announced meeting dates for 2012.  The meetings are open to the public.  Public comment will be accepted either in writing or orally during the last part of the meeting.

The NFAB will consider a variety of issues related to forest management including off-highway vehicle (OHV) travel management.

If you access the Black Hills National Forest either as a dual-sport, off-highway motorcycle or ATV rider then this is an opportunity to let the NFAB know how much you value your access to the forest and make them aware of any specific travel management issues.

Unless otherwise noted the meetings will be held at the Forest Service Center (8221 South Hwy 16, Rapid City, SD 57702) and will begin at 1PM and end no later than 5PM.

Motorcycle helmet bill stalled in Missouri Senate

Legislation allowing some motorcyclists to cruise Missouri’s highways without helmets has stalled in the state Senate.

The bill, SB743, would relax Missouri’s current helmet requirement so that it would apply only to people younger than 21.

Senators defeated an amendment Monday by Sen. Rob Schaaf — a physician from St. Joseph — stating that anyone injured while not wearing a helmet would not be eligible for Missouri’s Medicaid program. But opponents continued to speak against the bill, and senators set it aside without voting.

They could return to the legislation at a later date.

In 2009, Gov. Jay Nixon vetoed a similar bill that would have lifted the helmet required for motorcycle riders age 21 and older.

Biker Involved In Supreme Court Appeal

The South Dakota Supreme Court is considering an appeal in a case involving a Springfield motorcyclist who was awarded more than a half million dollars in a personal injury lawsuit even though he drank six beers just before the accident.

"Can you drink responsibly? The jury found the answer to be yes," Scott Hoy, attorney for injured motorcyclist John Walter, argued to the court Tuesday.

"How can anybody drink six beers in two hours and be drinking responsibly?" Gary Jensen, the attorney for farmer John Fuks, asked.

In 2009, John Walter and a friend were driving down a rural paved road in Yankton County on their motorcycles as part of a poker run.  That's when they got caught behind Tabor farmer John Fuks, who was driving his tractor.

Fuks started to turn his tractor left and crossed the center line; that's when Walter tried to pass him on his motorcycle on the right-hand side of the road.

Fuks decided to turn right into an approach and crossed back over the center line and collided with Walter.

"Now, what ended up happening is that his bucket hit Mr. Walter,” Hoy explained to the South Dakota Supreme Court justices. “Mr. Walter ended up in the ditch with a broken pelvis, lacerations to his face and lacerations all across his pelvis; $160,000 in medical bills.”

A jury awarded Walter more than a half million dollars as part of a personal injury lawsuit, finding that Fuks was at fault.

But at the time of the accident Walter had just drank six beers and had a blood alcohol level of 0.087 which is over the legal limit. An attorney for Fuks argues that Walter was at fault as well because he was legally drunk.

"Any reasonable person, if you hadn't been drinking six beers, would slow down and if necessary, you would stop. What you would not do, unless you're superman, you wouldn't zoom forward and try to pass the tractor on the right. You only do that if you've been drinking six beers," Jensen said.

Now, it's up to the South Dakota Supreme Court to decide if Walter's actions should also be considered negligent and whether the jury's decision should be overturned.

Walter was never prosecuted for driving drunk as part of the case.

The South Dakota Supreme Court will make a decision at a later date.

ABATE: Governor Signs Helmet Choice Law
Michigan joins 30 other states to allow adult choice on helmet use, toughens standards

       LANSING,  After 46 years, Michigan now joins 30 other states in amending the mandatory helmet law in favor of adult choice.  The Michigan legislature overwhelmingly approved SB 291 with broad bipartisan support, and Michigan Governor Rick Snyder signed Public Act #98 (SB 0291) into law today. The new law modernizes Michigan's outdated mandatory helmet law, which was a holdover from bygone days leaving Michigan, in the minority one of only 20 states left enforcing an empty federal mandate.
       The proposal to update Michigan,s mandatory helmet law was introduced in the Senate by Senator Phil Pavlov (R) St. Clair.
       "Every year, millions of dollars leave our state because of Michigan's outdated mandatory helmet law," Pavlov said. "This bipartisan plan will keep our dollars here, attract even more tourists to Michigan and help our state in these tough economic times."  Pavlov's bill also strengthened standards for allowing choice by mandating more stringent provisions then other helmet-free states.
   To ride helmet-free, motorcyclists must:
* Carry at least $20,000 in additional medical insurance.
* Be at least 21 years old.
* Have at least two years of riding experience or undergo special safety training.
       "We believe that the key to motorcycle safety, accident reduction and injury prevention lies in rider education, car driver awareness and license endorsement," said Jim Rhoades, Legislative Director for American Bikers Aiming Toward Education, or ABATE of Michigan. "We plan to continue providing certified motorcycle rider safety courses across the state at affordable rates so every rider can be educated before hitting the road."
   The law was written with input from ABATE, a motorcycle association dedicated to improving motorcycle safety and car driver awareness of motorcyclists on the roads. The new law gives Michigan the strictest requirements for riding helmet-free of any state that has modified mandatory helmet laws for adult choice (30 states). Allowing motorcyclists to ride helmet-free could also generate more than $1 billion in direct and indirect revenue, according to a recent Michigan Consultants study.
   "The problem is, helmet laws have done nothing to improve safety or reduce fatalities or the cost of insurance," said Vince Consiglio, President of ABATE of Michigan. "Motorcycle accidents are a very small percentage of accidents overall.  Data from other states has proven that states that remove mandatory helmet laws do not see an increase in insurance premiums, and states that institute helmet laws do not see a corresponding decrease in insurance rates.  It's never happened.  In addition, the leading insurance lobbyist was videotaped testifying before a senate committee last session that residents in Michigan will not see any rate increase as a result of the passage of this bill. This is yet another reason that we garnered such a large support base from the Michigan legislature".  Consiglio also wanted to extend ABATE's gratitude to "all of the legislative officials and Governor Rick Snyder who courageously supported freedom in the face of an onslaught of baseless and emotional arguments perpetuated by our opponents".

   The Michigan Licensed Beverage Association is a statewide trade association representing bars, restaurants, convenience stores and other class C license holders that also supported a change in the law.  "Every year we watch our customers ride into neighboring states and very few motorcycles ride in because of this law.  Our members near the Michigan borders are ecstatic!"  said Scott Ellis, the Executive Director of the MLBA. 
 
   ABATE Michigan has partnered with public schools and private driving instructors to teach more than 75,000 new drivers about motorcycle awareness, using resources donated by ABATE members.
       Since 1975, ABATE members have lobbied legislators to modify Michigan's outdated mandatory helmet law, which was a barrier to motorcycle tourism. At the same time, the previous law did nothing to reduce motorcycle injuries and fatalities.

The MRF is involved in federal and state legislation and regulations, motorcycling safety education, training, and public awareness. The MRF provides members and state motorcyclists' rights organizations with direction and information, and sponsors annual regional and national educational seminars for motorcyclists rights activists, as well as publishing a bi-monthly newsletter, THE MRF REPORT
