Subject: Someone is putting a halt to poker runs in Texas

This was in one of my south western groups and I thought it note worthy. Not sure if it will hold water up north here, or if we should even check our backs to make sure shit doesn't stick to our tires. But I thought it would be good reading. Maybe our club's attorney's could do some checking into.

Charity 'poker runs' will have to fold.  Attorney general rules motorcycle clubs' events are illegal gambling  By R.G. ATCLIFFE
Copyright 2005 Houston Chronicle Austin Bureau
AUSTIN - Motorcycle clubs that stage "poker runs" for charity will find 2006 less bountiful because Attorney General Greg Abbott ruled Tuesday that such fundraisers amount to illegal gambling under Texas law.

Poker runs typically have a participant paying a registration fee or have the motorcycle rider purchase cards or hands at various rally points.
At the end of the run, a cash prize is usually awarded for the best hand, the second-best hand and the worst hand.
Abbott ruled that a poker run with cash prizes would amount to a lottery under state law. He said an organization that kept part of the proceeds for charity would violate the state's prohibition on gambling.
"Even if the contribution goes to a charitable cause and the nonprofit organization will pay prizes from other money, a participant pays money for the chance to win a prize," Abbott said. "Thus we conclude ... the nonprofit organization would become a custodian of a bet in violation (of the state Penal Code)."
The ruling will broadly affect motorcycle organizations across Texas. At least seven have posted poker runs on the Internet through March. Charitable poker runs in the past year have been hosted by motorcycle clubs as well as police and fire departments around the state.
The poker run that prompted Abbott's opinion was organized by the Blue Knights Texas XXXI chapter to raise money for Galveston County Deputy Sheriff Michel Roy, who was injured in April when his squad car collided with a drunken driver's vehicle.
The Blue Knights is a motorcycle club consisting of active and retired police officers.
The club's advertised run said riders could buy hands for $10 each with no limit on the number of hands that could be purchased. At the end of the run, prizes would consist of $700 for the best hand, $200 for the second-best hand and $100 for the worst hand.
The Event drew complaint of Galveston County Criminal District Attorney Kurt Sistrunk said he received a citizen complaint on the poker run the day before it occurred. He said he called Blue Knights officers and asked them to call the event off.
"There was no getting around it, in my estimation, they would be violating the law if they pursued that event," Sistrunk said.
Blue Knights chapter President D.J. Alvarez said after that call, the club continued with the poker run, but canceled the cash prizes.
Alvarez said only three or four riders backed out of the Blue Knights run that weekend, but he said Abbott's ruling will have a serious impact on charitable poker runs across Texas.
"You have poker runs every weekend," said Alvarez, a lieutenant in the Galveston Police Department. "They're all for cancer organizations, charitable organizations."
He said they are especially useful in raising money for injured police or firefighters.
I want to know who the S.O.B. was that complained, and why..
Peace

And just in case some of you are unclear EXACTLY what ABATE is, here is a quick synopsis:
-------------

What is A.B.A.T.E?
A.B.A.T.E stands for A Brotherhood Aimed Towards Education.

Mission Statement

The mission of the members of A.B.A.T.E. of Illinois is to preserve the universal right to a safe, unrestricted motorcycling environment, and to propose and advocate actions that can be taken by elected and appointed officials to protect and conserve the natural resources of the State of Illinois, and ensure through professional management that sustainable use, recreational opportunities and enjoyment of these new resources is available for this and future generations.

Our Purpose

Political
We make every effort to influence State, National, and Worldwide political actions in favor of motorcycle rights.

Safety and Education
We conduct programs to Educate drivers, seniors, legislators, and motorcyclists.

History

Originally started by Easyriders magazine in 1971
First incorpororated in Illinois in 1975
Incorporated a second time in Illinois in 1986

ABATE is not a club, gang, or a Harley group, and we do not have back patches. Anyone that is interested in preserving their right to ride is welcome. And while we are a non-profit organization we are not a charity. We currently have over 12,000 members and 60 chapters throughout the state. ABATE consists of an Executive Board charged with conducting the day to day affairs of the organization; a Board of Directors which consists of 1 member from each chapter charged with setting policy, enforcing bylaws and guiding the organization. The members in each chapter provide input to the State through their board reps and drive the organization.

---------------

It is through this group that Illinois has been the ONLY state in the country to have maintained a right to choose, when it comes to the Helmet law. And they look out for all of us; on road and off road riders. The state politicians try to slip in bills underneath other orders that are covered up. It is our eagle-eye lobbyists that are working hard to help keep our rights to ride safe, ride free and to not have certain mishaps thrown upon us without our knowledge.

So, no matter what the weather, if you are not busy doing family plans, come show some support. Since I am a member, I will be working the first stop. And will probably help at the final destination, which is our VFW Post in Edwardsville.

Have a SAFE & FUN NEW YEAR's Eve!

Peace, Crazy Eagle

The BTW St. Louis Chapter IS ALIVE & WELL!!!. We had our first meeting after
reorganizing
on Saturday Dec. 17, 2005 at the Ponderosa in Fenton.

After we all ate, at 12:15PM Deacon motioned to start the meeting, & Elvis
second that motion.
Members that were in attendance were Crash & Gay, Deacon, Crazy, Elvis & Kathy.

First order of business - facility to hold our meetings.

We talked to the manager of Ponderosa about having the meeting there. Third
Saturday of
each month @ 11 AM. She agreed & we now have temporary meeting place.

Second order of business - nominations for Director & possible other positions.

Crash is now "temporary" Director for our Group. Elvis, Deacon, & Gay were
nominated
individually for the Director position after each that was nominated, all
declined. Deacon
nominated Crash as Director, but we are still open for nominations for Director

Current nominations are:

Director – Howard "Crash"
Secretary – Kathy
Treasure – Gay

If anyone has any other nominations for any of these positions please forward
them to Crash.
We will vote on positions at our next meeting in January.

Third order of business - dues.

In the past yearly dues were $10.00 per person. I vote will be taken at the
January meeting to
decide if we want to continue with the annual dues.

Remember, in order to vote on any Chapter related matters you must be a member
of the
International organization of BTW.

At present Crash is still Treasurer & treasury report was given.

It was discussed that a list of all Missouri and Illinois members of BTW be
obtained from the
main office of BTW and those members that were in a reasonable distance from St.
Louis be
sent a postcard letting them know about the Gateway Chapter, and where and when
we meet
and invite them to join us. Crash said that he would get the list of members
and go through it
and supply the postcards. It was agreed that the chapter would pay for the
mailing of the cards.
Any and all are welcome to join our group, the only requirement is that they are
a member of
BTW.

The meeting was adjourned at 1:15.

Minutes submitted by Kathy, Interim Secretary.

Missouri approves tracking cell phones for real-time traffic data

GARANCE BURKE

Associated Press

KANSAS CITY, Mo. - Missouri transportation officials approved a controversial
contract Friday that will allow a private corporation to track signals from
motorists' cell phones to map traffic snarls and highway congestion on major
roads throughout the state.

As early as next week, that company, the National Engineering Technology Corp.
(NET), will start monitoring thousands of cell phones in Kansas City and St.
Louis, using their movements to test how to relay traffic conditions to the
public in real time.

While officials say the program will make Missouri a national leader in
"intelligent" traffic management, privacy advocates are concerned that getting
more frequent travel time updates on road signs and Web sites may come at a
price.

"This is a leap forward in our nation," said Missouri Department of
Transportation Director Pete Rahn, minutes before the Highways and
Transportation Commission's unanimous vote to authorize the contract. "No
other department of transportation will be able to keep the users of their
system as well informed."

The program charts drivers' relative speed by measuring the time between the
intermittent signals cell phones send to towers along a stretch of road. Then,
that information - stripped of the personal identification and serial numbers
that identify the cell phone's owner - is overlaid with highway maps to
determine where the phones are and how fast they are moving.

In six months, transportation officials say, Missouri motorists will be able
to calculate their commute times by viewing such maps on the government's Web
sites. Distilled versions of the information will also be displayed on
electronic road signs along major highways, they said.

Cell phone monitoring already is being used by transportation officials in
Baltimore, though not yet to relay traffic conditions to the public. Similar
projects are getting under way in Norfolk, Va., and a stretch of Interstate 75
between Atlanta and Macon, Ga.

But monitoring phone signals along Missouri's 5,500 miles of major roads, many
of which run through rural areas where cell phone coverage is spotty, makes
for an additional challenge. On Friday, state officials had not determined
which cell phone companies would provide information for the program.

That raised eyebrows at the Electronic Privacy Information Center (EPIC).

"Consumers should have the right to opt into this public service," said Lillie
Coney, associate director of Washington, D.C.-based EPIC. "Missouri may be
creating a base for a new industry on the shoulders of the taxpayers."

Don Hillis, the director of system management for the Department of
Transportation, said the state explored other options to provide the traffic
flow information that motorists and logistics planners now expect and decided
that wireless data collection was the cheapest way to go.

"We'll be able to give our drivers traffic information throughout their
trips," said Hillis, who has overseen the project since its inception. "That
said, we recognize the importance of the privacy issue, and we wouldn't do
business with any company that would take any steps in the future to infringe
on those rights."

Hillis said regional planning commissions like the Mid-America Regional
Council and the East-West Gateway Council of Governments will also have free
access to the data to tackle congestion problems.

And as wireless technology evolves, Missouri officials believe there may be so
much interest from users outside the government - such as trucking companies,
satellite radio, mobile phones and GPS devices - that their investment could
pay for itself.

Under the terms of the $6.2 million, two-year contract, NET will wholly own
the information and is free to sell it to outside vendors that could profit
from offering just-in-time travel updates. The government has no authority to
monitor where the information ends up, but Hillis said that after two years,
the state may enter a revenue-sharing agreement with NET.

"If you travel on a certain route every day, we'll eventually be able to give
you alerts to see if an instance would keep you from getting to work on time,"
said Steven McDonald, a senior project manager for NET. "This has a lot of
potential."

My only comment on the meetings is; I was and am happy that two of my
clubs are on the same Saturday of the month. I would like to plan for
all bike events on one day. With the addition of a seperate date, that
just adds another factor in andthe chance of not being able to make
it. (Just MHO) Has anyone else discussed the idea of havng the
meetings on the same day but at a different time? Or has that idea not
even been considered?

I haven't got to throw my three cents in here yet and mess up the
wheels. so here they are.,.,., And does that mean the meeting is next
Saturday this Month??

Im not going to be laughing. I think FWD is the way to go. Mine was a 92 Chevy Cavalier that run into a ditch backwards and got hit in the side. The owners asked me to haul it away for them. I had the front half of the bike frame with the front end and a bunch of 3inch channel so I couldnt resist.

OK I'm primed and ready for your jokes. I am going to build one of
those front wheel drive donor car trikes. It's all I can afford and I
have lots of time.

I went on one of my governemtn auctions and purchased a 1994 Saturn LS
4 cyl for only $125.00! The rear end is wrecked but who needs that!

I am getting it towed back to the house via tow dolly after the
Thanksgiving Holiday. Then the fun begins.

I am selling my Goldwing to finance this project. Anyone know someone
who wants a 1981 Goldwing GL1100 for $1800.00?

Sorry it has taken me so long to welcome everyone that has joined the newly
reformed BTW
Gateway Chapter web-site, but as some of you know I have been a little busy
trying to get
things taken care of. Tiny and Lizard stop by my office yesterday (Tuesday) and
dropped off
the BTW items that Tiny had, including our Charter. I wrote Tiny a check for
half of the bank
account, so that concludes that.

To the new people that I haven't met yet, I look forward to doing so at our
meeting next month, I
hope you can make it. To those of you who I already know, I look forward to
continuing our
friendship and in some cases renewing our friendship from the past.

I have a place in mind for next months meeting, and when I can give everyone
exact directions I
will post them here. We are moving our meeting place back to the Missouri side
of the river.
Most of our members are from Missouri and I think it only makes sense to be
located in
Missouri.

Also we are going to change our meeting date to the third Saturday of the month.
We are doing
this because some people have expressed a desire to me to be part of Gateway
Chapter
and the River Rats. So by having our meetings on the third Saturday there will
be no conflict.
Again let me say that ANYONE and EVERYONE is welcome to join the Gateway Chapter
BTW. The only requirement is that you are a BTW member.

The BTW office along with Jerry, the State Director have been very supportive in
our efforts to
keep the Chapter going, and for this I am very thankful. I can't count the
number of emails that
we have sent back and forth trying to get everything worked out. With ALL of
use working
together we will get through this and be better for it.

OK, at the December meeting the one thing we will need to do is to elect a
Director for the
Chapter. I have taken the position as Interim right now just so we had a person
to keep it going.
Nominations for the position will be taken at the next meeting and voting will
be at the January
meeting. According to BTW the ONLY officer we need is Director, but I think
maybe a
Assistant Director and Sec./Tres. would be helpful also. So everyone have their
ideas on who
they would like to see nominated for these positions.

Well, I have talked your ears off enough, you know me once I get started I can't
stop, but I
wanted to let everyone know what was going on.

Until December, have a Good and Happy Thanksgiving all.

Howard "Crash"

PS - A couple of personal notes.

Kathy - Please help Elvis get on this site, he is still having problems.

Deacon - Glad to hear that everything is going well for you. Hope you can make
the next
                   meeting.

Dan - I see you live in Afton, I hope you will come to the meetings, this is a
great bunch of
           people.

And to Everyone - If you know of anyone who might be interested in joining,
please bring them
                                   to the next meeting.

Again - Keep It Free On Three - everyone

Hello folks,

My name is Deacon for those that don't know. I am a former member of
the Gateway Chapter that had a parting of ways that was a little
rough. I have put all that behind me and hope everyone else can too.
I respect Crash for keeping the Chapter alive and will do whatever I
can to help.

I have gone through alot in the past year, after loosing my temper
for the millionth time and alienating myself from my wife, my family
and several groups including the BTW I went to get a check up and
find out why my temper had gotten so bad. I found out I had a
golfball sized tumor in my head and had it removed.

Things have been golden since, no more temper and everything is so so
much easier.

I hope those who were in the group when I was at my worst can forgive
my comments and actions and give me a second chance.

God Bless
Deacon

Hello Jim,

I sent him the same letter and I would help him in anyway I could. But we e-mail each other all the time about the state stuff. Feedback is good with all of us in this brotherhood. Each and every Chapter should do the same....then were all on the same page. Talk to you later- Paw's just Jawin'

Crash, I want to personally thank you for stepping up to the plate and
taking over the Chapter in the St. Louis area. I really hated to see
it die out as I have to believe there are a lot of trikers in St.
Louis. I know that you will do a great job helping pull them together.
If there is any way we can help, you know where we are.
