Here in Apache Junction close to the Superstition Mountains where I live, there are many, many residential dirt roads that people drive to get to thier homes.

Actually did you look at the video, it was a promo for AZ Highways and the AZ Highways crew was ripping around. Sedona Off-Road has asked AZ Highways not to air the promo anymore as they do not approve of the way the rode, or at least that is what the owner claimed in an email to someone who had written to him.
It just makes us look bad, the cartoon in the Republic showing Jeeps and ATVs ripping up the desert, making dust with animals choking wasn't funny but thats the Republic for you, ANTI-Off-Road. They are owned by Gannett. Did you notice the link to the video starts out with Gannett ? Do you think they might have an agenda ?
Your friend is right we do have lots of rules, nothing is free anymore and while all of the Obama fever is going around, if he gets
elected things are going to get much worse for us.

I dont have any information about the County vs. Scottsdale issue so I can't comment on that, as screwed up as things are, im not shocked.
I just wanted to share the info on the newly published FACT sheet on the AZDEQ site and my conversation with James Wagner.
Yes, I see your point about the video, but I have a hard time critisizing them for simply wanting to advertising their business and enjoying the outdoors the same way we do, especiialy since the PM-10 rules dont apply to their area, as you stated.
But yes, I would not be suprised if that or any of the 1000's of videos on youtube get used as ammo against us.
A friend of mine was visiting from England recently and said to me before he left "...for a free country, you sure have a lot of rules to follow..!" how sadly true it is.

Craig, Maricopa County and Scottsdale to name a few could care less what AZEDQ says, they have their own rules apparently and are fighting each other on who has the right to control dust issues.
Scottsdale has closed a huge area from any activity due to "dust" issues and won a court battle to keep a ballot initiative out of the election that would have overturned their closure.
Then again, the PM10 rules do not apply in Sedona or most of the rest of the state for all that matters, just in our area.
Irregardless of what the regs are, the greens, general public and the politicians that are not friendly to us will look at something like that on TV and use it against us, you can count on it.
So while they may not have violated any rules, regs or laws, they used poor judgement in putting such a display on TV.

I spoke with James Wagner, the Director of the Air Quality devision of the AZDEQ this afternoon on this issue. They have recently published a FACT sheet on the new law to answer many of our questions, it can be found here:
Furthermore, the law only apply's on "PM-10 high particulate polution" days and NOT on a High Ozone Day or when the news or weather says "this is a high polution day..." last year there were only a total of 22 PM-10 days issued all year. In the FACT sheet there is a link to a page on the AZDEQ website where the OFFICIAL PM-10 high particulate polution advisory's are issued. Also it only applies to AREA-A, there is a link to the map in the FACT sheet.
When the PM-10 is issued, It also only applies to "recreational activity", if you are traveling for work or to and from your home, or any reason other than "recreation" you are NOT in violation. James admits that the term "recreation" is open to interpretation by the issuing officer and the honesty of the violator about what they are actually up to, this is obviously a major grey area...
James also said that the law itself is currently under revision due to all the confusion and the $10,000 fine amount is NOT for individual violations, for example, that fine is more in mind for construction company's that violate. For the individual:
First you get a simple warning, NO FINE
second is a $50.00 fine
third is a $100.00 fine
fourth and each after is a $250.00 fine
James is willing to personally attend any club/group event and directly answer any questions we have to "clear the air" (PUN) on this issue. I just need to let him know where and when if we want to have him come out.
