I've also hear about umbrella valves being put in the wrong spot.  They should be on the intake side of each rocker box.  I don't know what the effect is of putting them in the wrong spot but it's real easy to get them wrong.

I jumped the gun on my reply to your problem.  I re-read your post and realize that you already tried less oil, more oil, etc.  Sorry about that.  I don't know what the problem might be but you might try to ask the good folks at Badweb in the Oldschool section, if you haven't already been there, done that.

When you add oil to bring it up to the proper level on the dip stick you end up with way too much oil and it will blow the dipstick right out of the oil tank as you have described as you get on it or hit highway speeds. If that is what is happening don't feel too bad, it's a common occurrence when people are new to Tube framed Buells. I believe that the S3 is a two and a half quart system. If in doubt warm it up, drain it to be sure and add two quarts. One half quart will remain in the oil filter and oil passages. Then warm it up and check again and top off if necessary. It's better to run it a little low than a little high on oil because it will puke any excess oil out of the breather lines.

Seems like it's building pressure in the oil system, so that would lead
me to ask whether the oil breathers are blocked. Could be dirty (but
that's unlikely), could be faulty umbrella valves, could be somebody
decided to seal up the breathers so they don't leak oil mist, if it's
got a catch can, could be that the can's blocking airflow.

thanks for trying to help. it looks like it was a stuck BAS.

fyi I wasn't getting any spark at all. it started and ran fine and then i accidentally tipped it over and then it wouldn't start back up.
